Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CasinoComm platform ("Service") operated by CasinoComm ("CasinoComm", "we", "us"). By creating an account you ("Customer", "you") agree to these Terms.

1. The Service

CasinoComm is a software platform that lets casino operators send messages to their own opted-in players from the operator's own linked business number. We provide the software; you provide and control the audience, the content, and the consent.

2. Your account

You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be authorised to act for the casino you represent.

3. Fees

  • €250 per month, including 10,000 outbound messages.
  • Overage is charged at €100 per additional 5,000 messages (auto top-up may apply per your settings).
  • Fees are billed in advance via our payment processor. No rollover of unused messages; no free trial unless stated.
  • Discount codes, where offered, apply as described at checkout.

4. Your responsibilities and acceptable use

Your use of the Service is subject to our Acceptable Use Policy, which forms part of these Terms. In particular, you are solely responsible for: obtaining and recording valid consent from every recipient; honouring opt-out and self-exclusion; complying with all applicable laws (including data-protection, ePrivacy/marketing, advertising, and gambling regulation); and complying with the terms of any third-party messaging platform you connect, including WhatsApp/Meta.

5. Messaging platforms and deliverability

The Service sends via messaging platforms operated by third parties. We do not control those platforms and cannot guarantee message delivery, or that a connected number will not be rate-limited, restricted, or banned by the platform. You acknowledge and accept this risk. Connecting and using a third-party number is at your own risk and subject to that platform's own terms.

CasinoComm is not affiliated with, endorsed by, or sponsored by WhatsApp or Meta Platforms, Inc. WhatsApp is a trademark of Meta Platforms, Inc. You are responsible for ensuring your use complies with the applicable platform's terms.

6. Data protection

Where you upload or generate personal data of your players, you are the data controller and we are your processor. That processing is governed by our Data Processing Agreement, which forms part of these Terms. Our handling of your account and billing data is described in our Privacy Policy.

7. Intellectual property

We retain all rights in the Service and our software. You retain all rights in your data and content. You grant us the limited rights needed to provide the Service.

8. Warranties and disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and uninterrupted or error-free operation.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption. Our total aggregate liability under these Terms is limited to the fees you paid in the 12 months before the event giving rise to the claim. Nothing limits liability that cannot lawfully be limited.

10. Indemnity

You will indemnify and hold us harmless against claims, losses, and costs arising from your use of the Service in breach of these Terms or applicable law — including claims relating to lack of consent, unlawful marketing, or breach of a third-party platform's terms.

11. Suspension and termination

We may suspend or terminate your access for breach of these Terms or the Acceptable Use Policy, for non-payment, or where required to protect the Service or comply with law. You may cancel at any time; cancellation takes effect at the end of the current billing period.

12. Changes

We may update these Terms; we will give reasonable notice of material changes. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction, subject to any mandatory consumer or local-law rights.
